1. Scope of Application
1.1 These Terms and Conditions of AchievePrime GmbH apply to all contracts concluded between us and a consumer or business customer for the purchase of goods via our online shop.
1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business customer is any natural or legal person acting in the course of their commercial or professional activity.
2. Conclusion of Contract
2.1 The product descriptions in our online shop do not constitute binding offers. They serve as an invitation for the customer to submit a binding order.
2.2 The customer submits a binding offer by placing items in the shopping cart, completing the checkout process, and clicking the “Buy Now” button.
2.3 A contract is concluded when one of the following occurs:
- submission of an order via our online order form
- receipt of our written order confirmation by e-mail
- delivery of the ordered goods
- a request for payment after the order has been placed
2.4 Payment is processed via:
- Shopify Payments (including Stripe, credit cards, and other integrated methods)
- PayPal
3. Right of Withdrawal
3.1 Consumers have a statutory right of withdrawal. Details are provided in our Withdrawal Policy.
3.2 The full withdrawal instructions are available on our website.
3.3 The right of withdrawal does not apply to customers whose residence and delivery address at the time of the contract are outside the European Union and who are not citizens of an EU member state.
4. Prices and Payment Terms
4.1 All prices shown include statutory VAT.
4.2 For deliveries outside the EU, additional customs duties, taxes, or fees may apply, which are the responsibility of the customer.
5. Delivery and Shipping Conditions
5.1 Delivery is made to the shipping address provided by the customer. For PayPal payments, the address stored in the PayPal account applies.
5.2 Delivery times and shipping costs are clearly indicated during the checkout process.
5.3 Current delivery times and shipping rates are published on our website at https://www.achieveprime.com/pages/lieferung-und-versand.
5.4 Self-collection is not available.
5.5 If delivery fails due to circumstances attributable to the customer, any resulting additional costs shall be borne by the customer.
5.6 Gift vouchers are delivered by e-mail or as a digital download.
6. Retention of Title
The goods remain our property until full payment has been received.
7. Warranty (Liability for Defects)
7.1 The statutory warranty rights apply to all goods.
7.2 For used goods, the warranty period is one year from delivery, unless otherwise agreed. This does not apply to claims for damages, cases of fraudulent concealment of defects, or defects in goods typically used for construction purposes.
7.3 Consumers are asked to report obvious transport damage immediately to the carrier and notify us. Failure to do so does not affect the customer's statutory warranty rights.
8. Redeeming Promotional Vouchers
8.1 Only one promotional voucher may be redeemed per order.
8.2 The value of the goods must be at least equal to the voucher amount.
8.3 Remaining credit will not be refunded.
8.4 Promotional vouchers may only be redeemed during the specified validity period.
8.5 Promotional vouchers cannot be purchased.
8.6 A cash payout or interest is excluded.
9. Redeeming Gift Vouchers
9.1 Gift vouchers may be redeemed until the end of the third year following the year of purchase.
9.2 Only one gift voucher may be redeemed per order.
9.3 Gift vouchers cannot be used to purchase additional vouchers.
9.4 Cash payouts are not possible.
10. Applicable Law
The laws of the Federal Republic of Germany apply. For consumers, this applies only insofar as mandatory legal provisions in the country of residence do not provide stronger protection.
11. Place of Jurisdiction
If the customer is a merchant, the place of jurisdiction is Munich. For consumers, the statutory place of jurisdiction applies.
12. Alternative Dispute Resolution
The seller is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration body.
